Advisory services are provided under a separately executed engagement letter or statement of work. Nothing on this website constitutes legal, tax, or engineering advice for any specific building until an engagement is in place.
Website content and calculators
Tools such as the LL97 Carbon Exposure Calculator are provided for planning and educational purposes. Outputs depend on assumptions and inputs the user supplies and do not replace an audit, filing, or a stamped compliance report.
Payments
Fees for engagements are described in the applicable engagement letter. Where payment is processed through this website, payment services are provided by Stripe under Stripe's terms; BES does not store card data.
Refunds and cancellation
Refunds and cancellations follow the terms of the applicable engagement letter or product description. Advisory work already performed is non-refundable to the extent of the value delivered.
Intellectual property
The BES name, logos, methodologies, and website content are owned by BES. Clients receive a license to use deliverables for the intended building or portfolio purpose described in the engagement.
Prohibited use
Do not attempt to gain unauthorized access, scrape at volume, reverse engineer our tools, or use our services to violate law or third-party rights.
Disclaimer of warranties
The website and calculators are provided "as is." To the maximum extent permitted by law, BES disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by law, BES's liability arising from or related to use of the website is limited to fees actually paid to BES for the specific service that gave rise to the claim.
Governing law
These Terms are governed by the laws of the State of New York. Any dispute will be resolved in the state or federal courts located in New York County.
